FAQs Patent Questions

Question:Applicants may be required to provide speciments of the composition of their invention if necessary.

Answer:
The applicant may be required to furnish specimens of the composition, or of its ingredients or intermediates, for inspection or experiment. If the invention is a microbiological invention, a deposit of the micro-organism involved is required.

Question:A patent license makes sure the licensor does not sue the licensee.

Answer:
A patent license agreement is in essence nothing more than a promise by the licensor not to sue the licensee.

Question:Will the USPTO help me to select a patent attorney or agent to make my patent search or to prepare and prosecute my patent application?

Answer:
No. The Office cannot make this choice for you. However, your own friends or general attorney may help you in making a selection from among those listed as registered practitioners on the Office roster. Also, some bar associations operate lawyer referral services that maintain lists of patent lawyers available to accept new clients.
